1. SIGN-UP TERMS AND CONDITIONS

These Sign-Up Terms and Conditions apply when you create or use an account on the TBTuned remapping portal at portal.tbtuned.co.uk.

By registering for an account, you confirm that you have read, understood and agreed to these Sign-Up Terms and Conditions.

1. Portal operator

The Portal is operated by:

2. Trade use

The Portal is intended primarily for:

  • Vehicle tuning businesses;
  • Automotive technicians;
  • Garages and workshops;
  • Remapping professionals;
  • Motorsport businesses; and
  • Other competent automotive trade users.

By creating an account, you confirm that:

  1. You are at least 18 years old;
  2. You have authority to enter into a legally binding agreement;
  3. You are using the Portal for purposes connected with your trade or business;
  4. You have suitable automotive knowledge and experience;
  5. You have appropriate diagnostic, programming and voltage-support equipment;
  6. You understand the risks involved in reading and writing vehicle control units; and
  7. All registration information you provide is accurate and complete.

Where you register on behalf of a business, you confirm that you are authorised to accept these terms on its behalf.

3. Account approval

Creating an account does not guarantee approval or access to every Portal service.

TBTuned may request further information about:

  • Your business;
  • Your tuning tools;
  • Your experience;
  • Your location;
  • Your intended use of the Portal; and
  • The services you provide to customers.

TBTuned may approve, reject, restrict or suspend an account where reasonably necessary.

4. Account information

You must provide accurate and up-to-date information.

You must notify TBTuned if there is a change to your:

  • Name;
  • Business name;
  • Address;
  • Email address;
  • Telephone number;
  • VAT status; or
  • Other important account information.

TBTuned is not responsible for missed messages, files or account notices caused by incorrect contact information.

5. Account security

You are responsible for protecting your username, password and account access.

You must not:

  • Share your account with another unrelated person or business;
  • Sell, transfer, rent or sublicense your account;
  • Allow unauthorised persons to place orders;
  • Access another User’s account;
  • Attempt to bypass Portal security; or
  • Create additional accounts to avoid restrictions or unpaid balances.

You are responsible for orders and activity carried out through your account unless you notify TBTuned promptly that the account has been compromised.

6. Nature of the service

TBTuned provides modified ECU, TCU and other compatible vehicle software files.

Available services may include:

  • Performance tuning;
  • Economy tuning;
  • Fleet optimisation;
  • Engine and gearbox calibration;
  • Speed Limiter/Vmax modification;
  • Software fault solutions;
  • Calibration for modified vehicle hardware;
  • Motorsport or competition solutions; and
  • Emissions-related solutions where their supply and use are lawful.

The availability of an option on the Portal does not mean it is suitable or lawful for every vehicle, country or intended use.

7. Legal responsibility

Vehicle software modifications may be subject to laws relating to:

  • Emissions;
  • Roadworthiness;
  • Vehicle approval;
  • Insurance;
  • Warranties;
  • Finance agreements;
  • Noise;
  • Speed restrictions;
  • Motorsport;
  • Workplace safety; and
  • Public-road use.

You are solely responsible for checking whether a requested modification is lawful in every country, state or territory where the vehicle will be registered, tested, sold or used.

You must not request, install, advertise, sell or use a modified file unlawfully.

UK government guidance confirms that emissions modifications can have legal, safety and health implications, and modifying a vehicle so it no longer complies with its applicable emissions standard can make it unlawful for road use.

8. Emissions-related services

Emissions-related software services must not be installed or used on public-road vehicles where doing so would breach applicable law.

Depending on local law, these services may only be suitable for genuine:

  • Motorsport use;
  • Competition use;
  • Closed-course use;
  • Private-land use;
  • Research and development;
  • Diagnostic testing;
  • Export vehicles;
  • Agricultural machinery;
  • Industrial machinery;
  • Plant machinery; or
  • Other lawful non-road applications.

Selecting or signing an “off-road”, “motorsport”, “export” or similar declaration does not make an otherwise unlawful use lawful.

TBTuned may refuse any request where its legality, purpose or safety is unclear.

9. Vehicle owner’s permission

You must have the vehicle owner’s permission before:

  • Reading the vehicle;
  • Uploading vehicle software;
  • Requesting a modification;
  • Installing a modified file; or
  • Sharing vehicle-related information with TBTuned.

You are responsible for explaining the modification and its possible legal, mechanical, insurance and warranty consequences to the vehicle owner.

10. Your relationship with your customer

Your contract with the vehicle owner or end customer is separate from your contract with TBTuned.

You are responsible for:

  • Inspecting the vehicle;
  • Advising the customer;
  • Quoting the customer;
  • Obtaining consent;
  • Installing the file;
  • Testing the vehicle;
  • Supplying invoices;
  • Dealing with complaints; and
  • Providing any warranty or after-sales service you promise.

The vehicle owner does not automatically become a direct customer of TBTuned.

11. Intellectual property

Your account gives you access to TBTuned’s Portal and services. It does not transfer ownership of:

  • Portal software;
  • Website content;
  • Vehicle databases;
  • Modified files;
  • Calibration methods;
  • Technical information;
  • Branding; or
  • Other intellectual property.

Files may only be used for the individual vehicle and order for which they were supplied.

You must not share, sell, publish, reproduce, reverse-engineer or upload supplied files to another tuning provider or file database.

12. Suspension or termination

TBTuned may restrict, suspend or terminate your account if:

  • You breach these terms;
  • You provide false information;
  • You share your account;
  • You fail to make payment;
  • You initiate a fraudulent chargeback;
  • You misuse or redistribute files;
  • You behave abusively;
  • You request unlawful services;
  • You attempt to compromise Portal security; or
  • Continued access may expose TBTuned or another party to risk.

Account termination does not remove any outstanding payment obligation or liability arising before termination.

13. Acceptance

By creating an account, you confirm:

I have read and accept the TBTuned Sign-Up Terms and Conditions. I confirm that I am competent to use vehicle tuning services and that I am responsible for checking the legality, suitability, installation and use of every service requested through my account.

You should not upload unnecessary personal information.

6. Who we share information with

We may share information with trusted service providers that help us operate the business, including:

  • Portal hosting providers;
  • Cloud-storage providers;
  • Payment processors;
  • Email providers;
  • Messaging providers;
  • Analytics providers;
  • Security and fraud-prevention providers;
  • Accountants;

  • Technical file developers or subcontractors; and
  • Government bodies, courts or regulators where legally required.

Service providers may only use information as necessary to provide their services or comply with the law.

We do not sell personal information to advertisers.

Unsubscribing from marketing will not stop essential account, order, payment or security messages.

Users must independently verify legality, suitability and compliance.

Emissions and road-use notice

Such modifications must not be used on public roads where doing so would breach applicable law.
